This is an interesting turn of events. I was under the impression that, as per Delta's PWA, Comair and ASA were the only Delta affiliates permitted to operate 70 passenger aircraft -- even if other affiliates were using such an aircraft on a different codeshare (or independently).
Case-in-point = ACA. When Independance ordered the Airbus they were in violation of the Delta PWA and therefore lost their Delta Connection contract. (is that correct?)
So, that being the case, once Chautauqua takes delivery of the first Embraer 170 -- even if it is flown in UAL colors -- will they still be permitted to fly as Delta Connection?

Republic will use Chautauqua jets
Republic Airways has decided to use Chautauqua Airlines jets to fly regional routes for United Airlines until its new subsidiary gets certification to fly 70-seat jets.
Republic originally had planned to use 50-seat jets on the routes, but now plans to use the larger jets starting in October. Chautauqua's sister carrier, Republic Airlines, hasn't been certified for the larger planes yet and the company said it expects Chautauqua will get certification by October. Chautauqua's maintenance base is in Louisville.
