Not that I'm defending this guy...trust me I'm not, but you can certainly obtain a type without an ATP. The paragraph below is from the following FAA PDF file link: faa.gov/library/manuals/.../8700/volume2/media/2_009_00.pdf

3. GENERAL. [FONT=Times New Roman,Times New Roman]An aircraft type rating may be added to a private pilot, commercial pilot, or ATP certificate. However, type rating practical tests are conducted to a single standard for all certificate levels.
