Background check

Does anyone know the correct procedure to obtain a BACKGROUND check for NON-U.S.CITIZEN in order to fly an A/C over 12,500 lbs????
This is a new procedure that came out after SEP 11 and even the FAA doesn't know exactly how to obtain it. They claimed that it has nothing to do with their agency, but with the Dept. of Justice.
Any tip would be greatly appreciated.
