As far as I know, you are allowed to take the ATP ride with a expired written if you are employed by a 121 or 135 carrier (not including on demand). How about if you work for a company and do scheduled runs on some days and on demand others. Or if the company does both on demand and scheduled runs and you have done both in your career with the company? Can you still use the expired ATP written?

Here are the pertinent parts of 61.39:

Prerequisites for practical tests.

(a) Except as provided in paragraphs (b) and (c) of this section, to be eligible for a practical test for a certificate or rating issued under this part, an applicant must:
(1) Pass the required knowledge test within the 24-calendar-month period preceding the month the applicant completes the practical test, if a knowledge test is required;
(2) Present the knowledge test report at the time of application for the practical test, if a knowledge test is required;
........
(b) Notwithstanding the provisions of paragraphs (a)(1) and (2) of this section, an applicant for an airline transport pilot certificate or an additional rating to an airline transport certificate may take the practical test for that certificate or rating with an expired knowledge test report, provided that the applicant:
(1) Is employed as a flight crewmember by a certificate holder under part 121, 125, or 135 of this chapter at the time of the practical test and has satisfactorily accomplished that operator's approved--
(i) Pilot in command aircraft qualification training program that is appropriate to the certificate and rating sought; and
(ii) Qualification training requirements appropriate to the certificate and rating sought;......
*****************
It has nothing to do with what your employ was when you took the written or what you did since as long as you are currently involved and trained by your employer in Part 121, 125, or 135 when the PRACTICAL is taken.

Do you work for on demand company?

Steve,

You better go through your company's training guy and ask the POI. The last interpretation from the FAA that I read on this, was that you had to be continuously employed by the certificate holder from the time of expiration of the written to take the practical. Your POI may or may not let you do the practical with your expired written, depending on current interpretation.

Yes, its on-demand. If the wording is correct posted by andy neil then it doesn't matter if its on-demand. I'll read it in its entirety for myself. There may be another reg that excludes on-demand guys. Also is there a reg that excludes guys if you weren't continuously employeed by the certificate employer.
