Do the pilots have to pay dues even if they don't join USAPA? In otherwords is it a "closed shop" like ALPA was.
 
Good question...

Unless USAPA legally has the previous ALPA CBA binding (sorry to use the B-word, I know its is very offensive to the East)... then yes... (I don't know, I am not a lawyer)

If it is binding, then why switch union brands, just negotiate via the majority for your precious DOH.

It it isn't binding, then the West simply doesn't pay it, a couple of lawsuits from Westies and USAPA goes BK.


Finally, has anyone seen a USAPA member pin? or are USAPA members going to look like strike breakers?
If they do come up with a pin... what color will it be? Yellow.

First, some definitions.

Closed Shop: membership and dues mandatory

Open Shop: neither are mandatory

Agency Shop: membership is optional but an Agency Fee is mandatory

All US union carriers are Agency Shops. (The RLA prohibits Closed Shops and the last Open shop was AA until 2003.) The Agency Fee is determined by a yearly audit and is around 85% of full dues.

Now to your question. Failure to pay agency fee or dues is grounds for termination. Historically, it's very rare for a pilot to get to the point of being fired. The USAPA has yet to impose Agency Shop provisions at USAirways but inevitably they shall. So right now we aren't required to pay anything -- yet.
 
As the contracts that remain effective on both sides strictly define "the association" as ALPA and there is zero reference to USAPA or even the possability of their being another CBA, none of the agency rules apply.

In other words, Agency fees are only required to be paid if ALPA is the CBA, The contracts are still effective until a joint contract is ratified.

Bottom Line, USAPA will get nothing but lawsuits from the west...not one solitary dime in fees/dues.
 
just curious...

are any east pilots paying dues yet? I haven't received word one from USAPA. Of course I'm not paying dues but i expected them to at least ask.....lol

Actually, FedEx was an open shop until our latest contract in 2006. The company has to agree to agency shop (at least in TN). We had been trying to get agency shop for a while and the company wouldn't agree to it.
